topical cosmetic use as outlined in 21 CFR Parts 73 & 74. Consumer Awareness: While these
color ingredients have been used for many years with minimal adverse reactions for
permanent cosmetics and tattoo pigments, the FDA restricts the use of these color
ingredients and are not indended for injection into the skin as outlined in FDA
21 CFR Parts 70.5(b). "FDA considers the inks used in intradermal
tattoos, including permanent makeup, to be cosmetics and considers the pigments used in
the inks to be color additives requiring premarket approval under the Federal Food, Drug,
and Cosmetic Act. However, because of other public health priorities and a previous lack
of evidence of safety concerns, FDA has not traditionally regulated tattoo inks or the
